These Terms & Conditions (“Terms”) govern your use of darasphere.com and any purchase or requested service from DaraSphere. By using the website or placing an order, you agree to these Terms. If you do not agree, do not use the website or place an order.

1. About DaraSphere

DaraSphere is an online pet-care, aquascaping and lifestyle store based in Dubai, United Arab Emirates. Our correspondence location is 5629+73P, Dubai, United Arab Emirates. You may contact us at support@darasphere.com or through our Contact page.

2. Eligibility and accounts

You must have legal capacity to enter into a contract or use the website with the involvement of a parent or legal guardian. Account details must be accurate and kept secure. You are responsible for activity under your account and should notify us promptly of suspected unauthorised use. We may suspend access where reasonably necessary for security, misuse or legal compliance.

3. Product information

We aim to describe products, compatibility, dimensions, materials, colours and images accurately. Display settings, manufacturing changes and natural variation may create minor differences. You are responsible for checking measurements, compatibility, animal suitability, electrical requirements and destination restrictions before ordering. Product content is general information and is not veterinary, medical or professional advice.

4. Availability and orders

Submitting an order is an offer to purchase. An automated acknowledgement does not necessarily mean that the order has been accepted. A contract is formed when we expressly confirm acceptance or dispatch, subject to applicable law. We may refuse or cancel an order before fulfilment for stock errors, pricing errors, suspected fraud, delivery restrictions, payment failure, legal requirements or inability to supply. If we cancel after receiving payment, the relevant amount will be refunded.

5. Prices, currency and taxes

Prices and the available currency are displayed on the website and may change before an order is accepted. Delivery charges, taxes or other charges will be shown or communicated where applicable. International customers may be responsible for import VAT, duties, customs processing and brokerage charges unless expressly stated otherwise. We may correct an obvious pricing or description error before fulfilment.

6. Payment

Available payment methods are those displayed or expressly confirmed at checkout. You confirm that you are authorised to use the selected method. Payment providers may conduct security and authorisation checks under their own terms. Full card details are processed by the payment provider and are not intentionally stored by DaraSphere.

7. Shipping

Shipping availability, charges, processing, estimates, tracking, destination restrictions and delivery problems are governed by our Shipping Policy. Any delivery date is an estimate unless expressly guaranteed in writing. You must provide accurate delivery and contact information.

8. Cancellations, returns and refunds

Order cancellation, return eligibility, damaged or incorrect items, exclusions and refund processing are governed by our Returns & Refund Policy. Nothing in these Terms excludes mandatory consumer rights available under applicable law.

9. Reviews and user content

If you submit a review, comment, image or other content, you confirm that it is accurate to your honest experience, lawful, non-infringing and does not contain another person’s private information without permission. You grant DaraSphere a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display the content for operating and promoting the website and products. You retain ownership. We may moderate or remove content that violates these Terms, is misleading, unlawful, abusive, spam or unrelated.

10. Acceptable use

• Do not misuse the website, interfere with security or availability, introduce malicious code or attempt unauthorised access.
• Do not scrape, copy or exploit the website at scale without written permission.
• Do not use the website for fraud, unlawful activity, harassment or infringement.
• Do not misrepresent identity, affiliation, reviews or purchasing activity.

11. Intellectual property

The website design, DaraSphere branding, original text, graphics, photographs, downloads and other original materials are owned by or licensed to DaraSphere and protected by applicable intellectual-property law. You may access them for personal, non-commercial use. No broader right is granted without written permission. Third-party names and marks remain the property of their owners.

12. Third-party links and services

The website may link to or use services operated by third parties, including payment, delivery, maps and embedded content. Their services are governed by their own terms and privacy practices. A link does not by itself imply endorsement, and we are not responsible for third-party content outside our control.

13. Disclaimers

We provide the website with reasonable care but do not guarantee uninterrupted, error-free or completely secure access. General care, aquarium and pet information may not suit every animal, system or circumstance. Seek a qualified veterinarian or other appropriate professional for health, safety or specialist advice.

14. Liability

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or any mandatory consumer remedy. Subject to that rule, DaraSphere is not liable for indirect or consequential loss, loss of profit or data, or loss caused by misuse, incompatible installation, failure to follow instructions, unauthorised modification or events outside our reasonable control. 16. Changes

We may update these Terms for legal, operational or service changes. The version applicable to an order is the version in effect when the order is placed, unless a change is required by law. Continued use of the website after an updated version takes effect means you accept it for future use.

17. Governing law and disputes

These Terms are governed by the laws applicable in the United Arab Emirates and the Emirate of Dubai, without removing any mandatory consumer protection or jurisdiction rights you have in your country of residence. Please contact us first so we can try to resolve a concern promptly. Courts or competent authorities with mandatory jurisdiction remain available.

18. General terms

If a provision is invalid or unenforceable, the remaining provisions continue to apply. Delay in enforcing a right is not a waiver. You may not transfer your contractual rights without our consent, but we may transfer them as part of a lawful business reorganisation without reducing your rights.
